The Importance of Integrity

The owner of a stud dog must be a person of complete honesty and integrity, who has the interest of the breed at heart.

The stud dog owner should be reputable and have no devious intent to cheat the owner of the bitch out of any false mating or to fail to sign the official Kennel Club documentation.

The owner of the bitch is paying the stud dog owner for a service rather than paying for puppies, so any puppies born to the bitch are the property and responsibility of the owner of the bitch.

The stud dog owner has no jurisdiction over the raising or sale of the puppies from any litter sired by his/her dog.

Breeding Etiquette

Normally, it is the bitch that is taken to the male and the stud fee, agreed upon in advance, is payable at the time of service.

The owner of the stud dog should give a receipt and a Certificate of Service. This records the registration number and name of the sire (stud dog) and the bitch (dam), the date (or dates) when the mating takes place and the date when the puppies are normally expected.

It should state the fee and any additional terms agreed upon by the owners of the stud and the bitch.

In the event that no puppies result from the mating, a return service is not obligatory unless specified in the stud Certificate of Service and then, it is to the same bitch at her next season and with the same dog.

Some stud owners specify that one puppy, dead or alive, constitutes a litter, while others will give a return service if at least one puppy, from the mating, does not survive.

If the bitch fails to whelp a litter, it is the obligation of her owner to notify the owner of the stud within seven days of the expected date of whelping.

Sometimes an arrangement is made between the owner of the bitch and stud dog for a puppy out of the litter in lieu of a fee.

The agreement might specify Pick of the Litter or Second Choice, allowing the owner of the bitch to make the first selection.

In the case of a one puppy litter the agreement usually provides for payment of the stud service at this time, rather than the stud owner taking the only living puppy from the breeder and its bitch.

The details of any such agreement, plus a specified age when any such selection of a puppy should be made, must be stated in the stud agreement at the time of service.

Verbal agreements are neither valid nor enforceable.
